Terms & Conditions

These Terms govern your access to and use of the JDAC freight booking platform and all shipping services we provide across Cargo, Rail, Bus, Air and Courier. Please read them carefully before booking a consignment.

Please note. By creating an account, booking a shipment, or otherwise using the JDAC platform or services, you confirm that you have read, understood and agreed to be bound by these Terms & Conditions and our Privacy Policy. If you do not agree, you must not use the platform or our services.

Acceptance of Terms

These Terms & Conditions ("Terms") constitute a legally binding agreement between you ("you", "User", "Shipper" or "Customer") and JDAC Logistics ("JDAC", "we", "us" or "our"), the operator of the website and mobile application available at ship.jdaclogistics.com (the "Platform").

The Terms apply to every visit to the Platform, every account created, and every shipment, quotation or transaction booked through JDAC. They work alongside any service-specific terms, rate cards, or written agreements that may apply to a particular booking; where there is a conflict, the service-specific document prevails for that booking only.

You must be at least 18 years of age and legally capable of entering into a binding contract. If you use the Platform on behalf of a business or other entity, you represent that you are authorised to bind that entity to these Terms.

Definitions

In these Terms, unless the context requires otherwise:

  • "Consignment" means any goods, parcel, package or cargo tendered to JDAC for transport under a single booking and waybill.
  • "Waybill" / "Docket" means the shipping document or digital record issued by JDAC that identifies a Consignment and references these Terms.
  • "Shipper" / "Consignor" means the person or entity who books a shipment and tenders the Consignment for carriage.
  • "Consignee" means the person or entity named to receive the Consignment at the delivery address.
  • "Carrier" means JDAC and any transport partner, agent or contractor engaged by JDAC to perform all or part of the carriage.
  • "Chargeable Weight" means the greater of the actual gross weight and the volumetric (dimensional) weight of a Consignment.
  • "Services" means freight booking, transport, tracking and related logistics services offered through the Platform.

Scope of Services

JDAC is a technology-enabled logistics platform that allows Users to obtain quotations, book freight, and track Consignments across multiple transport modes within India, including:

  • Cargo & Surface Transport — road freight for heavy and bulk consignments;
  • Rail Cargo — movement of goods via railway networks;
  • Bus Cargo — parcel and small-freight transport on intercity bus routes;
  • Air Cargo — expedited domestic air freight;
  • Courier & Express — parcel and document delivery.

JDAC may perform Services directly or arrange for them to be performed by carefully selected transport partners. Service availability, transit times, coverage areas and rates vary by mode, route, and consignment profile, and are displayed on the Platform at the time of booking.

Indicative transit times and "same-day pickup" availability are estimates only and are not guaranteed unless expressly confirmed in writing for a specific booking.

Account Registration

Certain features of the Platform require you to register for an account. You agree to provide accurate, current and complete information during registration and to keep it updated.

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You must notify JDAC immediately of any unauthorised use or suspected breach of security. JDAC is not liable for any loss arising from your failure to safeguard your credentials.

You agree not to share, sell or transfer your account, and not to create an account using false identity details or on behalf of another person without authorisation.

Booking & Orders

A booking is created when you submit consignment details through the Platform and receive a confirmation with a unique waybill or booking reference. A quotation displayed before confirmation is an estimate and does not constitute a binding contract.

JDAC reserves the right to accept or decline any booking at its discretion, including where consignment details are incomplete or inaccurate, where the goods are restricted, or where service is unavailable on the requested route.

You are responsible for ensuring that all information you provide — including weight, dimensions, contents description, declared value, pickup and delivery addresses, and contact numbers — is true, complete and accurate. JDAC relies on this information to price and route the Consignment.

Important If the actual weight, dimensions or contents of a Consignment differ from the details provided at booking, JDAC may re-weigh and re-measure the Consignment and revise charges accordingly. The revised charges will be payable by the Shipper.

Pricing, Charges & Payment

Freight charges are calculated on the basis of the Chargeable Weight, transport mode, route, distance, and any value-added services selected. Rates are displayed on the Platform and are exclusive of applicable taxes unless stated otherwise.

6.1 Additional charges

The following may attract additional charges, where applicable: fuel surcharges, handling of oversized or fragile goods, loading/unloading assistance, multiple pickup or delivery attempts, demurrage or storage, address corrections, return-to-origin, and Cash-on-Delivery facilitation.

6.2 Taxes

All charges are subject to Goods and Services Tax (GST) and any other levies imposed by applicable law. A valid tax invoice will be issued in accordance with Indian tax regulations.

6.3 Payment

Payment must be made through the methods offered on the Platform (such as UPI, cards, net-banking, wallets, or approved credit terms for registered business accounts). For prepaid bookings, the Consignment will be processed only after payment is confirmed. JDAC may exercise a lien over any Consignment and related documents until all sums due — for that Consignment or any other — have been paid in full.

6.4 Pricing changes

JDAC may revise its rates and charges from time to time. Revised rates apply to bookings made after the revision takes effect and do not affect already confirmed bookings.

Pickup & Delivery

Pickup will be attempted from the address provided at booking during operating hours. The Shipper must ensure the Consignment is ready, properly packed and accessible at the scheduled pickup time, and that a representative is available to hand it over.

Delivery will be made to the Consignee at the delivery address. JDAC may obtain a signature, one-time password, photograph, or other proof of delivery. Delivery to any person present at the address who appears authorised to receive the Consignment, or to a security desk, mailroom or reception, shall constitute valid delivery.

If delivery cannot be completed after reasonable attempts — for example, due to an incorrect address, the Consignee being unavailable, or refusal to accept — JDAC may hold the Consignment in storage, attempt redelivery, or return it to the Shipper. Storage, redelivery and return charges will apply and are payable by the Shipper.

Undeliverable goods If a Consignment remains unclaimed or undeliverable for an extended period despite notice to the Shipper, JDAC may, to the extent permitted by law, dispose of the goods to recover outstanding charges. Perishable or hazardous goods may be disposed of sooner where necessary.

Packaging Requirements

The Shipper is solely responsible for packing each Consignment securely and appropriately for the nature of the goods and the transport mode, so that it can withstand normal handling, loading, stacking and movement.

  • Use sturdy outer packaging suited to the weight and fragility of the contents.
  • Cushion and immobilise contents to prevent internal movement and damage.
  • Clearly label the package with complete sender and recipient details.
  • Mark fragile, heavy, or orientation-sensitive goods appropriately.
  • Ensure no sharp edges, leaks or protrusions that may injure handlers or damage other consignments.

JDAC shall not be liable for loss or damage caused wholly or partly by inadequate, unsuitable or defective packaging, or by goods that were inherently unsuited to the transport mode booked.

Prohibited & Restricted Goods

You must not tender, and JDAC will not knowingly carry, any goods that are illegal to transport or that are prohibited or restricted under applicable law or by JDAC's transport partners. Prohibited goods include, without limitation:

  • Explosives, ammunition and fireworks
  • Flammable, corrosive or toxic substances
  • Narcotics and illegal drugs
  • Live animals and human remains
  • Counterfeit or pirated goods
  • Currency, bullion and negotiable instruments
  • Firearms and prohibited weapons
  • Hazardous and radioactive materials
  • Perishables without prior approval
  • Any goods banned by Indian law

Certain goods are restricted and may be carried only with JDAC's prior written approval, correct declaration, and compliance with applicable handling, documentation and packaging rules. If you tender prohibited goods, or restricted goods without approval, you do so at your own risk and will be fully liable for any resulting loss, damage, fine, penalty or claim, and JDAC may refuse, return, detain or hand over such goods to the authorities.

Shipper Obligations & Warranties

By tendering a Consignment, the Shipper warrants that:

  1. the description, weight, dimensions, value and contents declared are true, complete and accurate;
  2. the Consignment does not contain prohibited goods and complies with all applicable laws and these Terms;
  3. the goods are properly and securely packed and lawfully owned or controlled by the Shipper;
  4. all documentation required for carriage — including, where applicable, e-way bills, invoices and permits — has been provided and is accurate; and
  5. the Shipper has the authority to make a contract of carriage on these Terms, including on behalf of any other person interested in the Consignment.

The Shipper shall indemnify JDAC against all consequences of any breach of these warranties.

Inspection of Consignments

JDAC and its transport partners, and any government or regulatory authority, may open and inspect any Consignment at any time without notice for reasons of safety, security, regulatory compliance, or verification of declared contents, weight and dimensions. JDAC is not obliged to carry out such inspection and assumes no liability for failing to detect non-compliant goods.

Liability & Limitations

JDAC will perform the Services with reasonable care and skill. However, our liability for loss of or damage to a Consignment is limited as set out below.

12.1 Limitation of liability

Unless a higher value has been declared and an additional risk-coverage charge has been paid and accepted by JDAC, our maximum aggregate liability for any loss, damage, mis-delivery or non-delivery of a Consignment shall be limited to the lower of (a) the actual proven value of the goods lost or damaged, or (b) the limit specified for the relevant service on the Platform or rate card at the time of booking.

12.2 Exclusions

JDAC shall not be liable for:

  • indirect, incidental, consequential or special losses, including loss of profit, revenue, business, contracts or goodwill;
  • loss or damage caused by inadequate packaging, inherent defect or natural characteristics of the goods, or inaccurate declaration;
  • loss or damage arising from prohibited or undeclared restricted goods;
  • delay, where transit times are estimates and not guaranteed;
  • events of Force Majeure as described in Section 15; and
  • acts or omissions of the Shipper, Consignee or any third party.

Nothing in these Terms excludes or limits any liability that cannot lawfully be excluded or limited under applicable Indian law.

Insurance & Risk Coverage

The standard carriage charge does not include transit insurance. Consignments are carried at "owner's risk" unless optional risk coverage or transit insurance is purchased at the time of booking and reflected on the waybill.

Where you wish to protect goods for their full value, you must declare the correct value and select the available coverage option. We strongly recommend that Shippers arrange adequate insurance for valuable, fragile or high-risk consignments. Any claim under purchased coverage is subject to the terms, limits and exclusions of the relevant coverage policy.

Claims, Refunds & Cancellation

14.1 Filing a claim

Any claim for loss, damage or shortage must be reported to JDAC in writing as soon as possible and, in any event, within [7] days of delivery or expected delivery. Visible damage or shortage should be noted on the proof of delivery at the time of receipt. Claims submitted after the stated period may not be entertained.

A valid claim must be supported by the waybill number, proof of value (such as an invoice), photographs of damage where applicable, and any other documents reasonably requested by JDAC. JDAC will assess and respond to claims within a reasonable time.

14.2 Cancellation

Bookings may be cancelled through the Platform before pickup. Cancellation charges may apply once a pickup has been dispatched or the Consignment has been collected, to cover costs already incurred. The applicable cancellation policy is shown at the time of booking.

14.3 Refunds

Approved refunds — for eligible cancellations, overcharges, or undelivered prepaid consignments — will be processed to the original payment method as described in our Refund Policy. Service charges already incurred and non-refundable fees may be deducted.

Delays & Force Majeure

JDAC shall not be liable for any delay, loss, damage or failure to perform its obligations where this is caused by events beyond its reasonable control, including but not limited to: acts of God, natural disasters, floods, fire, earthquakes, extreme weather; war, riots, civil unrest, terrorism; strikes or labour disputes; government action, regulatory restrictions, road closures or curfews; epidemics or pandemics; vehicle breakdown or accident; and disruption to transport, fuel or communication networks.

If a Force Majeure event continues for an extended period, JDAC may suspend or terminate the affected Services without liability, while remaining responsible for the safe handling of any Consignment already in its custody, so far as reasonably practicable.

Indemnification

You agree to indemnify, defend and hold harmless JDAC, its directors, employees, agents and transport partners from and against all claims, demands, liabilities, damages, losses, fines, penalties, costs and expenses (including reasonable legal fees) arising out of or connected with: (a) your breach of these Terms; (b) any inaccurate or incomplete information you provide; (c) the tendering of prohibited or undeclared restricted goods; (d) your violation of any law or the rights of any third party; and (e) your misuse of the Platform.

Privacy & Data

JDAC collects and processes personal and shipment information to provide the Services, communicate with you, process payments, comply with legal obligations, and improve the Platform. Our handling of personal data is described in our Privacy Policy, which forms part of these Terms.

By using the Platform, you consent to the collection, use and sharing of your information with transport partners and authorities as necessary to perform the Services and meet legal requirements. We apply reasonable technical and organisational measures to protect your data.

Intellectual Property

All content on the Platform — including the JDAC name, logo, trademarks, software, design, text, graphics and the arrangement of these — is owned by or licensed to JDAC and is protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable and revocable licence to use the Platform solely for booking and managing shipments.

You must not copy, reproduce, modify, distribute, reverse-engineer, scrape, or create derivative works from any part of the Platform, or use JDAC's marks, without our prior written consent.

Suspension & Termination

JDAC may suspend, restrict or terminate your access to the Platform or any Service, with or without notice, where we reasonably believe you have breached these Terms, provided false information, engaged in fraudulent or unlawful activity, tendered prohibited goods, or where required by law.

You may stop using the Platform and close your account at any time. Termination does not affect any rights, obligations or liabilities that accrued before termination, including outstanding payments and accrued claims.

Governing Law & Disputes

These Terms and any dispute or claim arising out of or in connection with them, the Platform, or the Services shall be governed by and construed in accordance with the laws of India.

The parties shall first attempt to resolve any dispute amicably through good-faith discussion. Any dispute that cannot be resolved this way shall be subject to the exclusive jurisdiction of the competent courts at [City, State], India. Where the parties agree to arbitration, it shall be conducted under the Arbitration and Conciliation Act, 1996, by a sole arbitrator, with the seat at [City] and proceedings in English.

Changes to These Terms

JDAC may amend these Terms at any time to reflect changes in our Services, legal requirements or business practices. The updated Terms will be posted on the Platform with a revised "Last Updated" date. Material changes may be notified to you through the Platform or other reasonable means.

Your continued use of the Platform or Services after changes take effect constitutes your acceptance of the revised Terms. If you do not agree, you must stop using the Platform.

General Provisions

  • Entire agreement. These Terms, together with any service-specific terms and our Privacy Policy, form the entire agreement between you and JDAC regarding the Platform and Services.
  • Severability. If any provision is held invalid or unenforceable, the remaining provisions continue in full force and effect.
  • No waiver. A failure or delay by JDAC to enforce any provision is not a waiver of its right to do so later.
  • Assignment. You may not assign your rights or obligations under these Terms without JDAC's consent. JDAC may assign or subcontract its rights and obligations.
  • Notices. Notices to you may be sent to the contact details registered with your account. Notices to JDAC must be sent to the contact details below.
  • Headings. Section headings are for convenience only and do not affect interpretation.
